Police say he was shot dead during a failed robbery, and accomplices with him escaped. The dead man had not been identified at the time, pending notification of his next of kin.According to a police report a semi-automatic pistol, $2,000 in cash and half a pound of marijuana was recovered from the apartment, leading investigators to surmise the robbery was drug-related.No arrests were made, but the shooting will be referred to a grand jury, police said.Under the Texas Penal Code a person is justified in using deadly force against another to protect land or tangible moving property \u201cto prevent the other\u2019s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime,\u201d or to \u201cprevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property.\u201dTexas law has historically allowed deadly force against intruders to protect lives and property.
